Houston TX—The recent ruling of U.S. Supreme Court against the Defense of Marriage Act, has paved the way for same sex couples to file immigration visa petitions. Secretary of Homeland Security Janet Napolitano, issued a mandate on July 2, 2013 that all petitions for same sex marriage partners would be processed swiftly and smoothly just like opposite sex couples.
Couples that married in states that allow same sex marriages but reside in a state that does not can still apply. According to Secretary Napolitano, “In evaluating, the petition, as a general matter, USCIS looks to the law of the place the marriage took place when determining whether it is valid for immigration law purposes.”
